These Terms are the agreement between you and Watch My Date. Read them together with our Disclaimer, Privacy Policy, and Cookie Policy, which are part of this agreement.
1. Acceptance
By accessing or using WatchMyDate.com (the "Service"), operated by HiveCode LLC, you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service is
The Service is an educational archive and a set of tools that compile and visualize publicly available U.S. Visa Bulletin and immigration data. It is provided for general information only and is not a substitute for professional advice. The full scope of what we do and do not provide is set out in the Disclaimer, incorporated here by reference.
3. Eligibility
You must be at least 18 years old and able to enter a binding contract. By using the Service you confirm that you meet these requirements.
4. Your account
- Provide accurate information and keep your credentials confidential.
- You are responsible for activity under your account.
- Tell us promptly at support@watchmydate.com of any unauthorized use.
5. No legal advice
You acknowledge that the Service gives no legal advice, forms no attorney–client relationship (including for paid plans), and that all output is illustrative only, as fully described in the Disclaimer.
6. Acceptable use
You agree not to:
- Scrape, crawl, bulk-download, or systematically extract the archive or database except through features we expressly provide;
- Resell, redistribute, or commercially exploit our compiled data, charts, or tools without our written permission;
- Register accounts by automated means, share or resell a single-user subscription, or use the Service to send spam or strain our infrastructure;
- Reverse engineer, probe, disrupt, overload, or gain unauthorized access to the Service;
- Use the Service unlawfully or in breach of these Terms.
7. Intellectual property
The underlying government data is in the public domain. Our selection, arrangement, compilation, presentation, software, charts, text, and branding are owned by HiveCode LLC and protected by copyright, database, and related rights (including, where applicable, the EU/UK sui generis database right). We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your own personal, non-commercial purposes. All rights not expressly granted are reserved.
8. Feedback
If you send us suggestions or feedback, you grant us a perpetual, royalty-free license to use them to improve the Service, without obligation to you.
9. Subscriptions, pricing & billing
Some features require a paid subscription. The plans, features, prices, and billing cycle (for example, monthly or annual) are shown at sign-up. Payments are handled by our third-party payment processor ([e.g. Stripe]); by subscribing you authorize us and our processor to charge your chosen payment method for the subscription fees and any applicable taxes. You agree to keep your billing details accurate and current. We may change prices or plan features; for existing subscribers, price changes apply only from the next billing period and we will give advance notice as required by law. We may offer the Service, or parts of it, free of charge and may change what is free or paid at any time.
10. Automatic renewal & cancellation
Unless stated otherwise at purchase, paid subscriptions renew automatically at the end of each billing period at the then-current price, until you cancel. We will send renewal or cancellation reminders where the law requires. You may cancel at any time through [your account settings] or by emailing billing@watchmydate.com. Cancellation stops future renewals; it takes effect at the end of the current paid period, and you keep access until then. You will not be charged for periods after the one in which you cancel.
11. Refunds
Except where required by law, subscription fees are non-refundable, and we do not provide refunds or credits for partial periods, plan downgrades, or unused time. If you are a consumer in a jurisdiction with a statutory withdrawal or cooling-off right (such as the EU/UK 14-day right), that right applies; where you ask us to begin providing paid digital access immediately, you may, to the extent the law allows, lose that withdrawal right once access begins, and we will ask you to acknowledge this at checkout. 12. Changes to, or discontinuation of, the Service
We may add, modify, suspend, or discontinue any part of the Service — free or paid — at any time. If we permanently discontinue a paid feature you have prepaid for, we will, as required by law, provide a pro-rata refund for the unused prepaid portion or a comparable alternative, at our reasonable discretion.
13. Accuracy & "as is" service
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the data is correct or current, or that the Service will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, HiveCode LLC and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your reliance on the Service or its data — including decisions about immigration status, employment, travel, or finances. Our total aggregate liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100. Nothing here excludes liability that cannot be excluded under applicable law, and mandatory consumer-protection rights in your country of residence are unaffected.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless HiveCode LLC and its operators from claims, damages, and reasonable expenses arising from your use of the Service or your breach of these Terms.
16. Third-party services & links
The Service depends on third parties (such as hosting, authentication, payment processing, and analytics) and links to external government sites. We are not responsible for third-party services or content.
17. Suspension & termination
We may suspend or end your access at any time, including for breach of these Terms or non-payment. You may stop using the Service and delete your account at any time; see §10–§11 for how cancellation and refunds work.
18. Changes to these Terms
We may modify these Terms. For material changes we will update the date above and give reasonable notice. Continued use after changes take effect means you accept them; if you do not agree, stop using the Service and cancel any subscription.
19. Time limit on claims
To the extent permitted by law, any claim arising out of or relating to the Service or these Terms must be brought within one (1) year after the claim arose; otherwise it is permanently barred. This does not apply where your local law forbids such a limit.
20. Governing law & disputes
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws rules. Except as stated below, the state and federal courts located in New York have exclusive jurisdiction over any matter not subject to arbitration — except where the mandatory law of your country of residence lets you bring proceedings locally.
20.1 — Talk to us first
Before starting any formal proceeding, you agree to contact us at support@watchmydate.com and give us 30 days to resolve the matter informally. Most issues can be settled this way.
20.2 — Binding individual arbitration
If we cannot resolve a dispute informally, you and HiveCode LLC agree that any dispute arising out of or relating to these Terms or the Service will be settled by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. As exceptions, either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to stop unauthorized access or misuse of intellectual property.
20.3 — Class-action and jury waiver
To the fullest extent permitted by law, disputes will proceed only on an individual basis and not as a class, consolidated, or representative action. You and HiveCode LLC waive any right to a jury trial and any right to participate in a class action or class-wide arbitration.
20.4 — Coordinated ("mass") arbitration
If 25 or more similar arbitration demands are filed by or with the coordination of the same or related counsel, the parties agree the demands will be administered in staged batches to manage fees and improve efficiency, and the arbitrator may apply the result of representative "bellwether" cases to the remaining demands.
20.5 — Your right to opt out
You may opt out of the arbitration agreement (§§20.2–20.4) within 30 days of first accepting these Terms by emailing support@watchmydate.com from your account address with the words "arbitration opt-out." Opting out does not affect any other part of these Terms.
Consumers outside the US: nothing in this section removes any mandatory right or protection available to you under the law of your country of residence. Where binding arbitration or a class-action waiver is not enforceable against you, it does not apply to you, and the remaining Terms continue in full force.
21. General
If any provision is unenforceable, the rest stays in effect. We may assign these Terms in connection with a merger, financing, or sale; you may not assign them without our consent. Our failure to enforce a provision is not a waiver. These Terms and the policies referenced here are the entire agreement between you and us regarding the Service.
